These Terms of Service ("Terms") govern your access to and use of the ClubHubPro platform, website, and related services (collectively, the "Service") operated by ClubHubPro ("we", "our", or "us"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Service.
By creating an account, subscribing to a plan, or otherwise accessing the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the Service on behalf of an organisation (such as a sports club), you represent and warrant that you have the authority to bind that organisation to these Terms, and references to "you" in these Terms include both you individually and the organisation you represent.
ClubHubPro is a cloud-based sports club management platform that provides tools for member management, team management, event scheduling, facility booking, financial administration, and communication. The Service is provided on a software-as-a-service (SaaS) basis and is accessible via web browsers. We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with reasonable notice where practicable.
To use certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must notify us immediately at hello@clubhubpro.com if you suspect any unauthorised use of your account.
You are responsible for ensuring that all users within your organisation who access the Service through your account comply with these Terms. You must not share your account credentials with unauthorised third parties or allow others to access the Service using your credentials.
ClubHubPro offers multiple subscription tiers (Starter, Pro, and Enterprise), each with different features and pricing. Subscription fees are billed in advance on a monthly or annual basis, depending on the billing cycle you select. All prices are displayed in euros and are exclusive of applicable taxes unless otherwise stated.
Payments are processed securely through Stripe. By providing your payment information, you authorise us to charge the applicable subscription fee to your designated payment method. If a payment fails, we will notify you and may suspend access to the Service until the outstanding balance is resolved. You may cancel your subscription at any time through your account settings. Cancellations take effect at the end of the current billing period, and no partial refunds are provided for unused time within a billing cycle.
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data. By using the Service, you consent to the data practices described in our Privacy Policy. Where you act as a data controller (for example, when you store member data on the platform), you are responsible for ensuring that your use of the Service complies with all applicable data protection laws, including the General Data Protection Regulation (GDPR). We act as a data processor on your behalf and will process personal data only in accordance with your instructions and these Terms.
The Service, including its original content, features, functionality, design, source code, trademarks, and branding, is and will remain the exclusive property of ClubHubPro and its licensors. The Service is protected by copyright, trademark, and other intellectual property laws of Ireland and international treaties. You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any part of the Service without our prior written consent. Your use of the Service does not grant you any ownership rights in the Service or its content.
You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:
To the maximum extent permitted by applicable law, ClubHubPro and its directors, employees, partners, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or in connection with your access to or use of (or inability to access or use) the Service. Our total aggregate liability for any claims arising under these Terms shall not exceed the amount you have paid us in the twelve (12) months preceding the event giving rise to the claim.
You agree to defend, indemnify, and hold harmless ClubHubPro, its directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any rights of a third party, including but not limited to intellectual property rights or privacy rights.
We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease. You may request an export of your data within 30 days of termination by contacting us at hello@clubhubpro.com. After 30 days, we reserve the right to permanently delete your data in accordance with our data retention policies.
We reserve the right to modify these Terms at any time. When we make changes, we will update the "Last updated" date at the top of this page and notify you via email or an in-app notification. Your continued use of the Service after the effective date of any modifications constitutes your acceptance of the updated Terms. If you do not agree to the modified Terms, you must stop using the Service and cancel your subscription.
These Terms shall be governed by and construed in accordance with the laws of Ireland, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts of Ireland, and you hereby consent to the personal jurisdiction and venue of such courts.
In the event of any dispute arising out of or relating to these Terms or the Service, the parties agree to first attempt to resolve the dispute through good-faith negotiation. If the dispute cannot be resolved through negotiation within 30 days, either party may submit the dispute to mediation administered by a mutually agreed-upon mediator in Dublin, Ireland. If mediation is unsuccessful, either party may pursue resolution through the courts of Ireland as described in the Governing Law section above.
